1. What Your Agreement Is
Before we start any work, you get a Service Agreement written for your project. It sets out what we'll build, how it's paid for, and whether you're renting it on Pay Monthly or buying it outright. You read it and sign it online on your private project page.
This page explains what that agreement generally covers, so you know where you stand before you get to the signature. Your own agreement is always specific to you, and it works alongside our Terms of Service.
Two ways, one simple rule. Rent it on Pay Monthly, or buy it outright as a custom build. Either way, your content, data, brand and domain are always yours.
2. Pay Monthly - Rent It
On Pay Monthly we design, build, host and look after your website for one monthly fee, with little or nothing upfront. We carry the time and cost of the build ourselves, which is what keeps your upfront cost so low.
- Your website is licensed to your business while your plan is active. It's never sold, and it doesn't become yours by staying on the plan.
- The design, code and structure of the website stay ours. Your words, images, data, brand and domain are always yours.
- There's no minimum term. Either of us can end it with 30 days' notice, and there's no exit fee.
- Want to own your website instead? Choose buy it outright.
3. Buy It Outright
A custom build at one fixed price, quoted and agreed before we start.
- Once every invoice is paid in full, the finished website or application is yours. Host it anywhere and have anyone work on it, with no further fees to us.
- Your design, content and data are yours outright.
- Our own reusable code inside it stays ours, and you get a permanent licence to use it as part of your own website or application. See section 7.
- If you'd like us to keep hosting and looking after it, you can add our management monthly, with no minimum term.
4. Payments
- Pay Monthly: your monthly fee starts on the 1st of the month after your website goes live, so you never pay monthly while it's being built. Please set up a standing order so it arrives before the 1st of each month. We still send an invoice each month for your records.
- Setup fees: bigger builds may have a one-off setup fee to keep the monthly down. If there is one, the amount and when it's due are in your agreement.
- Buy outright: paid in full when your website launches, or in stages, as set out in your agreement.
- All payments are by bank transfer, using the details on your invoice. Payments more than 14 days late may mean services are paused.
5. What's Included
Your agreement lists exactly what's included. On Pay Monthly that's usually the design and build, UK hosting, SSL, daily backups, security and updates, and small changes and support from the people who built it.
Anything bigger, such as a new section or feature, is talked through and quoted first. We won't start chargeable extra work without agreeing the cost with you.
6. Your Responsibilities
You agree to:
- send your words, images, logo and any logins we need, and give feedback when we ask, so the project stays on time;
- make sure the content you give us is yours to use and is accurate;
- keep any email addresses and logins you sign in with secure;
- pay as set out in your agreement;
- use your website lawfully, and tell us straight away if you think something's wrong.
7. Our Code
Everything we build uses our own reusable code, such as our admin systems, platforms, calculators, modules and code libraries. That code always stays ours.
- You may use it as part of your own website or application, for your own business.
- You may not copy, resell, sublicense or offer it, or anything built from it, as a product of your own.
- We may build similar features or our own versions of tools for other clients, without using your content, data or brand.
8. Leaving
- Give us 30 days' notice at any time. No minimum term and no exit fee.
- Your content, data and domain always come with you. We give you a full export and help move your domain.
- On Pay Monthly, keeping the website itself is by agreement, so please talk to us first. A website built on a third-party theme, such as a WordPress theme, can go with you as it is. Our own custom-built websites may be released at our discretion, free or for a charge agreed at the time.
- If we're the ones who end things, we may simply hand your website over at no charge.
- A website that moves away from us goes as it is, without our updates or support, and features that rely on our systems may not work.
9. PixelShop and PixelCRM
Our own products work the same way. On a monthly plan, PixelShop and PixelCRM are licensed software, never sold, with the licence active while the monthly fee is paid. Or they can be bought outright as a custom build. Each has its own agreement, which follows these same rules. See the PixelCRM Service Agreement.
10. Signing Online
Your agreement is on a private project page, opened with a one-time code sent to your email. You sign by ticking each section and typing your name, which is a legally valid electronic signature. We keep a record of the signing (your name, email, the time, IP address and device) and a fingerprint of the exact agreement, and email you a PDF copy straight away.
Signing confirms that:
- the work and the way you're paying are right;
- you understand whether you're renting (Pay Monthly) or buying outright;
- you understand that your content, data and domain are always yours;
- you've read and agree to our Terms of Service;
- you have the authority to sign for your business.
These are business agreements, so there's no consumer cooling-off period.
11. Questions
If anything isn't clear before you sign, just ask. We'd rather you knew exactly where you stand.
